Nicholas Yost, Sr., of York Township, York County, Pennsylvania.
The will was signed on 8 March 1787.

In
the Name of God, Amen;
I Nicholas Yost of York Township in the County of York and State of
Pennsylvania yeoman, being aged, infirm and Weak in Body – but of Sound
disposing Mind, Memory and understanding, thanks be unto God for all his
Mercies, do therefore think Proper and Convenient to make this my Last
Will and Testament in manner and form following.
That is to Say, Principally and first of all I commend my Soul into
the Hands of Almighty God who gave it, and my Remains to be decently
buried at the discretion of my Friends and Relations.
And as touching my Worldly Estate wherewith it hath pleased God to
bless me with in this Life, I give and dispose of the same as follows, Viz’
Imprimis It is my Will and I do hereby order that all my Just Debts and
Funeral Charges shall be fully paid and Satisfied; out of my Estate as
soon as may be after my decease by my Executors herein after named or the
Survivor of them.
Item, I give and bequeath unto my Beloved wife
Catharine, the Bed & Bedstead wherein we now lie with everything
thereunto belonging and six Sheets, also a Chest, the little Walnut Table,
three good Chairs, three Table Clothes, my Big Hymn Book, and a Book
called ‘True Christianity,” a good Cow, a Wash Tub, a Pail, a large
and a Small Iron Pot, a Pewter Dish & Bason, four Pewter Plates and
four Spoons, a Frying Pan and Skillet, three Ladles and a Skimmer a
Fleshfork, Oil Jug and Lamp, a Tea Kettle, Coffee Pot, Tea Ware, and two
white Baskets. And the
residue of my Personal Estate, I will and do hereby order that the same
shall be sold at Public Vendue as soon as may be after my decease by my
Executors hereinafter named or the Survivor of them.
Item, I will and do hereby order that my Executors
hereinafter named or the Survivor of them furnish my said wife yearly and
every year during her Natural Life, at the expence(sic) of my Estate –
with a Comfortable dwelling House with a garden and Stabling for a Cow, on
Ton of good Hay, ten Bushels of good Wheat, eight cords of Fine Wood,
eighty Pounds of Pork, fifty Pounds of Beef twelve pounds
[next page] pounds of Heckled Flax, Six Pounds of Wool, and eight Pounds
Lawful money of Pennsylvania in Specie.
Item, I give and bequeath unto my Son Abraham Yost the sum of five
shillings, in Specie, which is to be in full for his share out of my
Estate both Real & Personal he being heretofore advanced and because I
have often times been evilly treated by my said son’s wife (and for
other reasons best known to myself) give and bequeath the share or Portion
which was intended by me for my said son unto the Children lawfully
begotten by him to be paid to them in Manner & Form herein
aftermentioned.
Item, I will and do order that my Executors hereinafter named or the
Survivor of them shall at the Expiration of the Lease or Leases of my
Lands and Tenements or at any other convenient time sell the Same at
Public Vendue to the best Advantage, And I do hereby fully impower my
Executors hereinafter named or the Survivor of them – to make and
execute such Deeds or Conveyances unto the Purchaser or Purchasers of my
said Lands and Tenements, in as full and ample a manner to all intents and
Purposes as I myself might or could do, at this present time.
Item, I give and bequeath unto my Son in Law Conrad Laub intermarried with
my Daughter Mary Elizabeth and to his Heirs and assigns the Sum of thirty
nine Pounds in Specie to be paid as soon as may be after my decease.
Item, I give and bequeath unto my Son in Law Francis Streithoff
intermarried with my Daughter Anna Elizabeth the Sum of thirty nine Pounds
in Specie, to be paid to him his Heirs or Assigns as soon as may be after
my decease.
Item, I give and Bequeath unto my Son in Law Jacob Bernhart intermarried
with my Daughter Catharine and to his Heirs and Assigns the Sum of thirty
nine Pounds money aforesaid to be paid as soon as may be after my decease.
And after the decease of my said Wife I further give
and bequeath unto my said Son in Law Conrad Laub and to his Heirs and
Assigns the Sum of Forty seven Pounds.
And to my said Son in Law Francis Streithoff and to his Heirs and
Assigns the sum of Forty seven Pounds money aforesaid.
And to my said Son in Law Jacob Bernhart and to his Heirs (and)
[next page] and Assigns the Sum of Forty seven Pounds money aforesaid.
And to the Children of my Son Nicholas deceased, I give and
bequeath the Sum of Forty seven Pounds money aforesaid, to be equally
divided amongst them and their Heirs and Assigns share and share alike
when they respectively arrive to the age of twenty one years.
And the residue of my Estate (if any) I will and do order that the
same shall be divided into five equal Parts or Shares – one equal fifth
part thereof I give & bequeath unto my said Son-in-Law Conrad Laub,
and to his Heirs and Assigns, one other equal fifth part thereof I give
and bequeath unto my said Son in Law Francis Streithoff and to his Heirs
and Assigns, One other equal fifth part thereof, I give and bequeath unto
my Said Son in Law Jacob Bernhart and to his Heirs and Assigns, One other
equal fifth part thereof I
give and bequeath unto the Children of my said son Nicholas deceased, to
be equally divided amongst them Share and Share alike, when they
respectively arrive to the age of twenty one years.
And the other equal fifth part thereof I give and bequeath to the
Children lawfully begotten by my said Son Abraham to be equally divided
amongst them and their Heirs & Assigns share and share alike, when
they respectively arrive to the age of twenty one years.
And Lastly I do hereby nominate and appoint George Stake Esquire
and my said Son in Law Conrad Laub or the Survivor of them to be the
Executors of this my Last Will and Testament to execute the Same according
to the true intent & meaning thereof.
Ratifying and Confirming this and no other to be my Last Will and
Testament, In Witness whereof I have hereunto Set my Hand and Seal the
eighth Day of March in the year of our Lord one thousand Seven hundred and

marriage records of the Rev. John Waldschmidt, of the Cocalico, Moden Krick,
Weisseichen Land and Seltenreich Reformed Churches, published in the
Pennsylvania Archives, 6th Series, Vol VI, pp 231 and 234, Johann Nicolaus, son
of Nicolaus Jost, and Regina, daughter of Johann Philip Klingemann, were wed on
13 July 1773.

In the name of God Amen, I Nicholas Yost Junior of Shrewsbury Township in
the County of York and state of Pennsylvania Innkeeper, being weak in Body but
of Perfect, Sound and Disposing Mind, Memory and Understanding, Thanks be unto
God for the same, Do make and publish this my last Will and Testament in Manner
and Form following (to wit) Principally and first of all, I recommend my Soul

decent and Christian-like Manner at the discretion of the Executrix of this my
last Will and Testament and Guardian herein after Named.
Item, I will

my decease by two impartial and Judicious Men agreeable to Law) to the Guardian
of my Children herein after Named, which is to be equally distributed and
divided amongst all my Children Share and Share alike, or to his her or their
Heirs and Assigns; Provided always Nevertheless my said Wife Rachel shall
sufficiently, Cloath, Maintain and School my said Children until each of them
shall arrive to the Age of fourteen Years, otherwise to be accountable for two
thirds of my said Estate to the Guardian herein after named, immediately after
She shall or may refuse to keep, maintain and school my said Children in manner
and form aforesaid; And I further Will and direct, that in Case my said Wife
Wife shall happen to Marry again, before the youngest of my Children shall
arrive to fourteen years then and as soon as the same shall happen, to pay and
be Accountable for two thirds of my said Estate in Manner and Form aforesaid, or
else to give sufficient security unto the guardian herein after Named, for the
true and faithful Payment thereof when the Youngest of my said Children shall
arrive to the Age of fourteen Years as aforesaid, Provided they and each of them
is sufficiently kept, Maintained and Chooled (sic) as aforesaid, otherwise to be
accountable for the same, at the time of the refusal thereof as aforesaid.
And I further direct that as soon as my Sons, or either of them shall
arrive to the Age of fourteen Years, to be put out Apprentices to learn a Trade,
by and with the Consent and Approbation of the Guardian herein after Named.
And lastly I
do hereby nominate and appoint my said Wife Rachel Sole Executrix of this my
last Will and Testament, and my Brother in Law Conrad Laub Overseer, thereof, to
see and take Care that the same be kept and put in Execution according to the
true intent and meaning hereof, and also to be the Guardian of the Persons and
Estates of all my Children during their Minority. In Witness whereof I have hereunto set my Hand and Seal the
tenth Day of March Anno Domini one thousand Seven hundred and eighty five.
Note, The Words on
the first Page, “immediately after my decease” and on the second Page
“before the Youngest of my Children shall arrive to fourteen years” being

18 April 1779. According
to the baptismal records of the Rev. John Waldschmidt, of the Cocalico,
Moden Krick, Weisseichen Land and Seltenreich Reformed Churches, published
in the Pennsylvania Archives, 6th Series, Vol VI, p 176, Johannes, son of
Nicholaus Jost, Jr. & wife Regina, was born 18 April 1779 and baptized
2 May 1779. The sponsors were Johannes Klingeman & wife Christina.
Nicholas, Jr had other children who were baptized elsewhere.
Johannes Klingeman may have been the brother of Regina Klingemann Yost.
ii. ABRAHAM YOST, b. 10 May 1784,
probably, York County, Pennsylvania.. He
was baptized 7 July 1784. Abraham Jost and wife Elisabeth were sponsors.

Abraham Jost, sponsor, was probably Nicholas' older brother.
